Goldie & Co Limited, trading as Goldie & Co, provides the services covered by these terms. We use them for commercial photography, standard video, and web work unless something different is agreed in writing. Portrait and family photography use the photography terms, and Quick Social uses its own terms.
Scope
Work delivered follows the scope agreed in writing (email, quote, or invoice notes).
Anything outside that scope is quoted separately.
Deliverables and selection
For photography, the final delivered set is curated by Goldie & Co unless otherwise agreed.
Raw files are not delivered unless agreed and quoted.
Revisions
Photography: no revision rounds unless agreed beforehand. We may correct a technical error or make a minor tweak requested within 7 days.
Video: one round of reasonable revisions unless otherwise stated. A round is one consolidated set of feedback supplied at one time. It covers changes within the approved concept and scope, not a new direction, extra filming, or additional versions. Further changes are quoted separately at $120/hr + GST.
Timelines
Commercial photography is normally delivered within 4–8 weeks of the shoot and may take the full eight weeks during busy periods. Any materially different timeframe will be agreed in writing.
Standard video and web delivery varies by scope. Late feedback, delayed selections, or missing assets extend the delivery date by a reasonable period.
Access and permissions
Client is responsible for access and permissions at locations (e.g. hospitals), and any fees or approvals.
If access isn’t available at the agreed time, shoot time may be shortened or rescheduled.
Usage rights
Once paid in full, the Client receives an ongoing, non-exclusive licence to use the delivered work in its own marketing, website, social media, advertising, and print.
Goldie & Co retains copyright. The Client may not resell, sublicense, or provide the work to another business for unrelated use without written permission.
Goldie & Co may display the work in its portfolio, website, social media, and promotional material unless confidentiality is agreed in writing.
Payment
Invoices due in 7 days unless agreed otherwise.
Late payments may pause delivery of outstanding work.
Final files and usage rights may be withheld until all amounts due for the relevant work are paid.
Cancellations and rescheduling
With at least 48 hours' notice, the Client may move a shoot once without a rescheduling fee, subject to availability.
With less than 48 hours' notice or for a no-show, Goldie & Co may charge a reasonable cancellation or rescheduling fee reflecting work completed, non-recoverable costs, and loss directly caused by reserving the date.
If the Client cancels, Goldie & Co may retain from amounts paid only what is reasonably required to cover those items. Any remaining amount will be refunded.
If Goldie & Co cannot provide the agreed services, the Client may choose a reasonable reschedule or a refund for services not provided.
Liability
To the maximum extent permitted by law, Goldie & Co's liability is limited to the amount paid for the affected services.
This limitation does not apply to liability or remedies that cannot lawfully be limited or excluded.
Consumer rights and governing law
Nothing in these terms limits any rights or remedies available under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or other applicable New Zealand law.
These terms are governed by New Zealand law. Please contact us promptly if there is a problem so we can assess and remedy it.
