Terms of Service
By booking, paying an invoice, or proceeding with services, you agree to these terms.
Who provides the services
Goldie & Co Limited, trading as Goldie & Co, provides the services covered by these terms. Photography services are provided by Becky McEwan, whose legal name is Becky Kiriona.
1. Scope of Services
Becky McEwan provides photography services including, but not limited to, family, maternity, newborn, couples, and portrait photography.
Specific details relating to the session type, date, duration, location, pricing, and deliverables will be confirmed at the time of booking and outlined in the invoice or written confirmation.
2. Booking & Confirmation
A session is considered tentatively held until payment has been received.
A booking is confirmed only once the required payment or booking fee has been paid, unless otherwise agreed in writing.
Goldie & Co reserves the right to release unconfirmed dates.
3. Payment & Booking Fees
For sessions priced under $500 NZD, full payment is required at the time of booking.
For sessions priced $500 NZD and over, a 50% booking fee is required to secure the session date. The remaining balance is due two weeks prior to the scheduled session date.
The booking fee is credited toward the total session price.
Invoices are due within 7 days unless otherwise stated.
Overdue invoices may incur interest at a rate of 15% per annum, calculated daily.
All prices are in NZD. GST is charged where applicable.
Final images and usage rights may be withheld until payment is received in full.
4. Session Conduct & Responsibilities
Clients agree to:
- Arrive on time and prepared
- Ensure participants (including children) are supervised and safe
- Communicate any specific needs, sensitivities, or concerns prior to the session
Goldie & Co is not responsible for compromised coverage caused by late arrival, uncooperative participants, or environmental factors outside its reasonable control.
5. Creative Style & Editing
Clients acknowledge that they are booking Becky McEwan for her distinct photographic style, composition, retouching, and editing approach.
All delivered images are professionally retouched and finished in Becky McEwan's signature style. This may include colour correction, tonal shaping, and object removal where deemed appropriate by the photographer.
Requests to alter the stylistic direction, editing approach, or overall look of the images are not accommodated.
6. Image Selection & Delivery
The number of final images delivered may vary depending on the session type.
Final photography will normally be delivered within 4–8 weeks of the session and may take the full eight weeks during busy periods. Any materially different timeframe will be agreed in writing.
Images are delivered digitally unless otherwise agreed.
7. Revisions
Revisions are not offered.
The delivered images represent the final finished work as curated and completed by the photographer.
8. Cancellations & Rescheduling
With at least 48 hours' notice, the Client may move the session once without a rescheduling fee, subject to availability.
With less than 48 hours' notice or for a no-show, Goldie & Co may charge a reasonable cancellation or rescheduling fee reflecting work completed, non-recoverable costs, and loss directly caused by reserving the session time.
If the Client cancels, Goldie & Co may retain from amounts paid only what is reasonably required to cover those items. Any remaining amount will be refunded.
In the event of unsuitable weather, illness, or circumstances beyond either party's reasonable control, the Client and Goldie & Co will arrange a suitable reschedule where reasonably possible.
If Goldie & Co cannot provide the agreed session, the Client may choose a reasonable reschedule or a refund for services not provided.
9. Newborn Sessions (Additional Clause)
For newborn sessions, the Client acknowledges:
- Session timing is dependent on the baby's needs
- Safety and comfort take priority over specific shot requests or timing
- Sessions may be shortened or adapted as required
10. Usage Rights
Once payment is received in full, the Client is granted an ongoing, non-exclusive licence to use the delivered images for personal, non-commercial use.
Images may not be altered, filtered, or used for commercial purposes without written permission.
Goldie & Co retains copyright. Goldie & Co may use images for its portfolio, website, social media, and promotional purposes unless the Client requests confidentiality in writing. If the Client asks us not to publish images of a child, we will not use those images for those purposes.
11. Limitation of Liability
To the maximum extent permitted by law, Goldie & Co is not liable for:
- Weather conditions
- Behaviour of children or participants
- Third-party interruptions
- Loss of business, opportunity, or emotional distress arising from the session
To the maximum extent permitted by law, liability is limited to the amount paid for the affected services. This does not apply to liability or remedies that cannot lawfully be limited or excluded.
12. Consumer Rights & Governing Law
Nothing in these terms limits any rights or remedies available under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or other applicable New Zealand law.
These terms are governed by New Zealand law. Please contact us promptly if there is a problem so we can assess and remedy it.
13. Acceptance
By booking a photography session, paying an invoice, or signing electronically, the Client agrees to these Terms of Service.
